Axostichus ID Terms of Service

Welcome to Axostichus.org. These Terms of Service ("Terms") are an agreement between you and Axostichus.org ("we," "us," or "our"). They govern your use of Axostichus ID, our shared account, sign-in, and billing system, and every Service you access with it, including Snout.nu and Consequat (each, a "Service").

By creating an Axostichus ID or using any Service, you agree to these Terms. Each Service also has a lettered Addendum at the bottom of this document, describing terms specific to that Service. If a Service's Addendum conflicts with these core Terms, the Addendum controls for that Service.

1. Who Can Use Axostichus ID

You must be at least 18 years old to create an Axostichus ID or use any Service. By creating an account, you confirm that you are 18 or older and that you have the legal capacity to enter into this agreement.

2. Your Account

You're responsible for keeping your account credentials secure and for everything that happens under your account. Tell us right away if you think your account has been accessed without your permission.

You need a valid email address to create an Axostichus ID. You're responsible for keeping that email address current, since it's how we identify your account, help you recover access, and reach you about important account or billing matters.

You may not create an account using a false identity, impersonate someone else, or create an account for someone under 18.

3. Acceptable Use

You agree not to use any Service to:

We may remove content, suspend accounts, or take other action we reasonably believe is necessary to address a violation of this section, with or without advance notice, depending on the severity of the violation.

4. Your Content

You own the content you upload to a Service, including blog posts, images, and anything else you create or upload. By uploading content, you give us a limited license to store, host, and display that content as necessary to provide the Service to you and, where the content is public, to other users.

You're responsible for the content you upload and for making sure you have the rights to upload it. Don't upload anything that infringes someone else's copyright, trademark, or other rights.

You can delete your content at any time. Once deleted, it's removed from our production systems, though it may briefly persist in encrypted backups, as described in our Privacy Policy.

We respect intellectual property rights and expect users of our Services to do the same. If you believe content on a Service infringes your copyright, you can send us a notice under the Digital Millennium Copyright Act (DMCA).

To be effective, your notice must include:

  1. A physical or electronic signature of the copyright owner or someone authorized to act on their behalf
  2. Identification of the copyrighted work you claim has been infringed
  3. Identification of the specific material you claim is infringing, and information reasonably sufficient for us to locate it (such as a URL)
  4. Your contact information, including your address, phone number, and email address
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf

If we remove content in response to a valid notice, we'll let the user who uploaded it know and give them a chance to submit a counter-notice if they believe the content was removed in error. If we receive a valid counter-notice, we may restore the content after a period required by law, unless the original complaining party has filed a court action seeking to prevent it.

We may suspend or terminate the accounts of users who are found to be repeat infringers.

6. Fees and Billing

Some Services or features may require payment. Where they do, this is described in the Service's Addendum or at the point of purchase. All fees are billed through Axostichus ID and processed by our payment processor.

Fees are non-refundable except where required by law or as we otherwise state at the time of purchase.

7. Termination

You can delete your Axostichus ID at any time, which will close your account and access to all connected Services, subject to the data retention terms in our Privacy Policy.

We can suspend or terminate your account if you violate these Terms, including the Acceptable Use section above. Where the violation isn't severe, we'll generally try to warn you first and give you a chance to fix it. For serious violations, including illegal content, we may suspend or terminate your account immediately without notice.

8. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T PROMISE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. NOTHING IN THIS SECTION LIMITS ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR OUR GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT, OR ANY OTHER RIGHTS YOU HAVE AS A CONSUMER THAT CANNOT BE WAIVED UNDER THE LAW OF YOUR COUNTRY OF RESIDENCE.

9. Changes to These Terms

We may update these Terms from time to time. If we make a significant change, we'll notify you by email before it takes effect. If you don't agree with a change, you can close your account. Continuing to use a Service after a change takes effect means you accept the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules, except where applicable consumer protection law in your country of residence requires otherwise.

Addendum A: Snout.nu

If you use Snout.nu, the following additional terms apply:

Your blog. Snout.nu lets you publish blog posts and images under your own account. You're responsible for what you publish, including making sure you have the rights to any content you post.

Email forwarding. If you use the email forwarding feature, you're responsible for how you use forwarded messages and for not using the feature for anything unlawful, such as receiving content you know to be illegal.

Public content. Content you publish on your Snout.nu blog is public by default unless the feature you're using states otherwise. Don't publish anything you don't want to be publicly visible.

Addendum B: Consequat

If you use Consequat, the following additional terms apply:

Uploaded images. Consequat lets you upload, organize, and discover images. You're responsible for making sure you have the rights to upload any image, including images you did not create yourself. Don't upload an image unless you own it, have permission to use it, or its license otherwise allows it.

Discovery and recommendations. Consequat may show you images and recommendations based on your explicit feedback (such as "More" or "Less" on an image), as described in our Privacy Policy. You can adjust your feedback at any time by interacting with images differently going forward.

Reporting infringing or violating content. If you believe an image on Consequat infringes your copyright, follow the DMCA process in Section 5 above. If you believe an image violates our Acceptable Use policy for reasons other than copyright, contact us at legal@[this domain].
